Terms of Use

Agreement

These Terms govern your use of cmm-tech.com (the “Site”), operated by CMM – California Media Management, Inc. (“CMM”). By using the Site, you agree to them. If you do not agree, do not use the Site.

Business users only

CMM provides services to businesses only (B2B) and does not provide services to consumers. By using the Site or contacting us about services, you confirm that you act on behalf of a business or in a professional capacity, and that you are at least 18.

No offer or contract

Site content is general information. It is not an offer, a commitment or professional advice. Any services are governed solely by a separate signed agreement between CMM and the client. Examples, timelines, prices and metrics on the Site are illustrative and are not guarantees.

Intellectual property

The Site and its content, including the CMM name and logo, belong to CMM or its licensors. You may view and print pages for internal business use. Any other use requires our written permission.

Acceptable use

  • Do not break the law or infringe the rights of others.
  • Do not interfere with or attempt to gain unauthorized access to the Site.
  • Do not send malicious code, spam or false information through our forms.
  • Do not scrape the Site by automated means without our permission.

Your submissions

Do not send confidential information through the Site unless an NDA is in place. Information you send is handled under our Privacy Policy.

Third-party links

The Site may link to other websites. CMM does not control them and is not responsible for their content.

Disclaimer of warranties

THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE FULLEST EXTENT PERMITTED BY LAW, CMM DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.

Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, CMM IS NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR DATA, ARISING FROM YOUR USE OF THE SITE. CMM’S TOTAL LIABILITY RELATING TO THE SITE WILL NOT EXCEED $100. This section does not limit liability that cannot be limited by law.

Indemnification

You will defend and indemnify CMM against third-party claims arising from your breach of these Terms or misuse of the Site.

Governing law and venue

These Terms are governed by the laws of the State of California, without regard to conflict of laws rules. The state and federal courts located in Los Angeles County, California have exclusive jurisdiction, and you consent to that jurisdiction.

Changes and general terms

We may change these Terms by posting an update and changing the effective date. If a provision is unenforceable, the rest remains in effect. These Terms are the whole agreement about your use of the Site.
